ADA and government online resources offer responses to frequently asked questions about the Sunshine Act for dentists, dental labs, manufacturers and schools.
The Sunshine Act: FAQs for Dentists at ADA.org addresses questions about data collection and reporting requirements and the searchable Open Payments website currently under development for 2014 public accessibility. The FAQs for Dentists is available to ADA members. Reproduction by member dentists and their staff for use in the dental office is permitted. Any other use, duplication or distribution by any other party requires the prior written approval of the American Dental Association.
The Centers for Medicare & Medicaid Services offers responses to these FAQs at cms.gov:
• Is a manufacturer of dental alloys considered an applicable manufacturer for purposes of Open Payments? Are payments or other transfers of value provided to dental labs reportable or only payments or other transfers of value provided to dentists?
• Are dental schools that are affiliated with universities and health care institutions, but do not match the name or address information provided on CMS' teaching hospital list, still considered teaching hospitals for the purpose of reporting?
Both the ADA and CMS Sunshine Act resources address questions about speaker compensation at continuing education events meeting standards of the American Dental Association's Continuing Education Recognition Program. The ADA frequently asked questions are available to members. The CMS frequently asked questions are available to the public. The CMS also hosted webinars Nov. 14-20, 2013, to introduce features of the searchable Open Payments website currently in development.
Other ADA communication venues offering continuing reports on the Sunshine Act include the ADA News, ADA.org and the ADA advocacy website.
