The ADA's Dental Society Services is pleased to offer THE LOOP for its authorized users. Carefully read this User's Participation Agreement in its entirety before logging into THE LOOP. By logging into and accessing THE LOOP, you certify that you have read and agree to be bound by the terms and conditions contained in this Agreement. If you do not agree to these terms, do not log in and immediately exit from THE LOOP.

The purpose of THE LOOP is to facilitate internal communication among authorized users of THE LOOP by providing a forum for timely dissemination, retrieval, sharing and discussion of information and issues relevant to dental societies executives and officers. Participation in THE LOOP is limited to dental society executive directors and their staff, contract lobbyists, designated ADA staff, and invited guests to whom the ADA has granted user id's and passwords.

1. This Agreement may be modified from time to time without notice. All such modifications shall be effective upon their posting to THE LOOP. ADA recommends that you review this Agreement periodically to familiarize yourself with modifications to the Agreement.

2. All materials posted to (uploaded), received (downloaded) or otherwise obtained via THE LOOP ("Posted Information") is proprietary and is intended solely for the use and benefit of authorized users of THE LOOP.

3. Except where prior permission has been expressly granted or obtained from the owner of the Posted Information, you will not share, forward, distribute, discuss or otherwise disclose Posted Information to any individual who is not authorized to receive Posted Information.

4. You will take all reasonable precautions to protect the Posted Information (whether in oral, electronic or printed form) from any unauthorized disclosure and to prevent unauthorized individuals from having access to and/or obtaining any Posted Information.

5. Notwithstanding the foregoing, you understand and agree that ADA cannot guarantee the confidentiality of THE LOOP. Due to the very nature of the medium, Posted Information may be widely disseminated and unauthorized users may gain access to the Posted Information. Therefore, you should not use THE LOOP to transmit materials or hold discussions that are confidential in nature or attorney-client privilege.

6. You will abide by all rules and procedures regarding use of THE LOOP as established from time to time by the ADA's Dental Society Services.

7. THE LOOP may not be used to:

  • Practice dentistry online.
  • Violate the antitrust laws, including by facilitating any price fix, boycott, or market allocation.
  • Intentionally or unintentionally violate, or encourage others to violate, any law, regulation, treaty or tariff.
  • Post materials that are unrelated to THE LOOP's business and purpose.
  • Solicit, advertise or proselytize for outside commercial, religious, charitable, political or other causes.
  • Post materials intended for a specific individual (these should be sent through direct e-mail).
  • Post copyrighted materials without the permission of the copyright owner.
  • Post materials that infringe on any other intellectual property rights of others or on the privacy or publicity rights of others.
  • Post material that is obscene, defamatory, threatening, harassing, profane, sexist, racist, hateful, or embarrassing to another user or any other person or entity.
  • Impersonate another person, including by forging or removing email address information.
  • Damage the name of ADA, its societies, affiliates, subsidiaries, officers, agents and/or employees.
  • Interfere with other users' use or enjoyment of the service.

7. By posting material to THE LOOP, you grant ADA a royalty-free, perpetual, irrevocable nonexclusive license to use, reproduce, modify, publish, translate, distribute, perform and display any and all materials you post to THE LOOP alone or as part of other works in any form, media, or technology whether now known or hereafter developed and sublicense such rights through multiple tiers of sublicensees. Additionally, you grant other users the right to access, view, store, and reproduce your Posted Information for personal use.

8. ADA does not pre-screen postings to THE LOOP, nor verify the source. All postings to THE LOOP are made automatically and are identified by name and e-mail address. Unless otherwise stated, the views and opinions expressed on THE LOOP have not been approved by ADA and do not necessarily represent the opinions or policy of ADA.

9. ADA does not warrant the accuracy, completeness, timeliness, merchantability or fitness for a particular purpose of the materials posted in THE LOOP. ADA is not responsible for the acts or omissions of any third party or for the opinions and materials posted by others, including without limitation for any wrongdoing, such as incidents of harassment, slander, malice, defamation of character, copyright or trademark violations, or any civil or criminal actions that occur or are alleged to have occurred through the use of THE LOOP. The responsibility and defense against such actions or claims is solely that of the individual, and ADA assumes no responsibility for the content or consequences, direct or indirect, of the Posted Information. You agree to hold the ADA, its officers, trustees, employees and agents harmless with respect to the use of, or inability to use THE LOOP, including without limitation any information that you post on THE LOOP and your reliance on any information posted thereon.

10. ADA may remove any user from THE LOOP for violation of this agreement.

11. This Agreement shall be governed by and construed in accordance with the laws of the State of Illinois, and you agree to submit to the personal jurisdiction of the courts of Illinois for any cause or action arising out of your use of THE LOOP. In the event that any portion of this Agreement is determined by a court to be invalid, the remaining portions shall remain in full force and effect.
