Return to Top Litigation The ADA is always ready to explore possible
participation in lawsuits that
may be of national significance to dentistry.
Indeed, one of the Division of Legal
Affairs’ principal
roles is to provide legal advocacy
on behalf of the dental profession. The
protocol for providing support in
such cases appears in the Criteria
for Providing Financial Assistance in
Matters Having National Significance
Involving Constituent and Component Dental
Societies, Related Dental Organizations
and Individuals.
In contrast, the ADA typically does not provide litigation
assistance to dentists involved in private business disputes.
In such cases, dentists need to rely on their private counsel
for legal support. Dentists seeking information on securing
appropriate counsel for a particular case may wish to contact
their state or local dental society, their state or local
bar association, or their malpractice carrier for a referral.
While the ADA typically does not provide referrals to counsel,
the Division of Legal Affairs may on occasion supply names
of possible attorneys who may have particular subject matter
expertise when these other routes have not yielded a referral
for the member dentist.
